Terms of Use

By accessing or using Yard Genius Pro ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

Yard Genius Pro is a business management platform for landscape architects, landscape designers, and design-build firms. The Service includes lead pipeline management, proposal generation, contract templates with e-signature, automated follow-up sequences, aerial takeoff and estimating tools, a water-wise plant database, client lead capture forms, marketing content generation, and team management features.

When you sign up, an Organization is created for your firm. You become the owner of that Organization and can invite team members within your seat limit. You are responsible for all activity that occurs under your account and for keeping your password secure. Each user must have their own account — sharing login credentials is not permitted.

You are responsible for:

• Providing accurate information about your firm and business.
• Ensuring you have the right to upload any photos, documents, or client data submitted to the Service.
• Obtaining consent from your clients before storing their contact information, photos, or project details in the Service.
• Using the Service for legitimate business purposes only — not for spam, unsolicited marketing, or any unlawful activity.
• Ensuring that contracts, proposals, and other documents generated through the Service comply with applicable local laws, licensing requirements, and professional regulations in your jurisdiction.

Yard Genius Pro is a business tool, not a licensed landscape architecture firm. Contract templates, proposal language, and other document templates provided by the Service are starting points for your professional review and customization. You are solely responsible for the final content of any document you send to a client and for ensuring it meets professional standards and legal requirements in your jurisdiction.

AI-assisted content (proposals, scope descriptions, marketing copy) is generated by artificial intelligence and may contain errors or omissions. You must review all AI-generated content before sending it to clients.

Yard Genius Pro offers a single Pro plan at $97 per month, or $81 per month when billed annually. A 7-day free trial is available with no credit card required. Payments are processed by Stripe. You can cancel your subscription at any time from your account settings — cancellation takes effect at the end of your current billing period.

Your subscription includes a set number of team seats. You can invite team members up to your seat limit. Additional seats beyond your included limit may require a plan upgrade. Removing a team member frees up a seat for reassignment.

You are responsible for ensuring you have the right to store your clients' personal information (name, email, phone, address, project photos) in the Service. You must comply with applicable data protection laws, including GDPR and CCPA, when collecting and storing client data. Our handling of data is described in our Privacy Policy.

You retain ownership of all content you create using the Service — proposals, contracts, marketing copy, design concepts, and client data. You grant Yard Genius Pro a limited license to process your content through our systems and third-party AI services to provide the Service to you.

The Service itself, including templates, the plant database, and software code, is owned by Yard Genius Pro and licensed to you on a subscription basis during your active subscription.

You agree not to:

• Use the Service to store or process data that you do not have the right to store.
• Attempt to access, tamper with, or reverse-engineer the Service's systems or infrastructure.
• Use the lead capture forms to collect data from individuals without their consent or for purposes other than legitimate business inquiries.
• Resell, sublicense, or provide the Service to third parties without authorization.

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for downtime, data loss, or service interruptions beyond our reasonable control.

To the maximum extent permitted by law, Yard Genius Pro shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you have paid in the preceding 12 months.

You may cancel your subscription at any time from your account settings. You may also delete your Organization and all associated data by contacting us. We reserve the right to terminate accounts that violate these Terms or that remain unpaid.

These Terms are governed by the laws of the State of California, United States.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
